Fiorello La Guardia, the former mayor of
New York City for three successive terms,
had worked as a city judge.
뉴욕 시장을 세 번이나 연임했던
피오렐로 라과디아는 시장으로 재직하기 직전
그곳의 법원 판사로 일하고 있었습니다.
He presided over the trial of an old man
who was charged with stealing a loaf of bread
from a store in 1930.
1930년 어느 날.
상점에서 빵 한 덩어리를 훔치고
절도혐의로 기소된 노인을 재판을 하게 되었습니다.
"Have you ever stolen bread before?"
"No, this was the first time."
"Why did you steal it?"
"I lived honestly as a decent citizen. However,
being old, I am unable to get a job. I couldn't eat
for three days. I was dying of starvation and
had no money. So I stole a loaf of bread
out of desperation."
"전에도 빵을 훔친 적이 있습니까?"
"아닙니다. 처음 훔쳤습니다."
"왜 훔쳤습니까?"
"예, 저는 선량한 시민으로 열심히 살았습니다.
그러나 나이가 많다는 이유로 일자리를
얻을 수 없었습니다. 사흘을 굶었습니다.
배는 고픈데 수중에 돈은 다 떨어지고 눈에는
보이는 게 없었습니다.
배고픔을 참지 못해 저도 모르게
빵 한 덩어리를 훔쳤습니다."
Judge Laguardia made ruling.
"No matter what difficulties you suffer,
stealing is a sin. The law does not discriminate
and there are no exceptions. Therefore,
you are to be fined 10 dollars. "
라과디아 판사는 노인의 딱한 사정을 듣고
곧 판결을 내렸습니다.
"아무리 사정이 딱하다 할지라도
남의 것을 훔치는 것은 잘못입니다.
법은 만인에게 평등하고 예외가 없습니다.
그래서 법대로 당신을 판결할 수밖에 없습니다.
당신에게 10달러의 벌금형을 선고합니다."
People watching the trial were dumbfounded,
for they expected the judge to give a lenient
sentence. The decision seemed draconian and inhumane.
방청석에서는 판사가 노인의 딱한 사정을
감안해 관대하게 선처할 줄 알았는데...
뜻밖의 단호한 판결에 여기저기서
술렁거리기 시작했습니다.
Judge La Guardia continued his statement.
"The theft of a loaf of bread by this
old man is not only his responsibility.
라과디아 판사는 논고를 계속했습니다.
"이 노인이 빵 한 덩어리를 훔친 것은
오로지 이 노인의 책임만은 아닙니다.
All of the citizens in this city share the
responsibility, for they left him in difficulty
and with not choice but to steal bread.
이 도시에 살고 있는 우리 모두에게도,
이 노인이 살기 위해 빵을 훔쳐야만 할 정도로
어려운 상황임에도 아무런 도움을 주지 않고
방치한 책임이 있는 것입니다.
Therefore, all of the citizens in the courtroom
are to be fined for 50 cents and myself 10 dollars. "
그래서 나는 나에게도 10달러의 벌금형을 동시에,
이 법정에 앉아 있는 여러 시민 모두에게
각각 50센트의 벌금형을 선고합니다."
Then the judge took ten bucks out of
his wallet and put it into his hat.
"Bailiff, please collect fines from everyone."
The judge had him circulate the hat through
the spectators.
그러면서 그는 자기 지갑에서
10달러를 꺼내어 모자에 담았습니다.
"경무관, 당장 모두에게 벌금을 거두시오."
판사는 모자를 모든 방청객들에게 돌리게 했습니다.
No one objected the judge's decision.
아무도 판사의 선고에 이의를
제기하는 사람은 없었습니다.
The sum came to $57.50. Judge LaGuardia ordered
the bailiff to give the money to the old man.
그렇게 해서 거두어진 돈은
57달러 50센트였습니다.
라과디아 판사는 그 돈을 노인에게 주도록 했습니다.
The old man paid the fine and left the court
with $47.50 in his hand, shedding tears
of appreciation.
노인은 돈을 받아서 10달러를 벌금으로 내었고,
남은 47달러 50센트를 손에 쥐고
